The Department of Justice and Constitutional Development announced that suspects accused of murdering Kiernan “AKA” Forbes and Tebello Motsoane withdrew their extradition appeal in Eswatini.
"The Minister of Justice and Constitutional Development,Mmamoloko Kubayi,welcomes the confirmation that Siyabonga Gezani Ndimande and Malusi Dave Ndimande,who are accused of murdering the late South African musician Kiernan ‘AKA’ Forbes and Tebello Motsoane,have withdrawn their appeal against extradition from the Kingdom of Eswatini to the Republic of South Africa.
"The Minister received an update today,Thursday,30 October 2025,from the National Directorate of Public Prosecutions(NDPP),confirming receipt of a Notice of Abandonment from the Kingdom of Eswatini authorities,signalling the withdrawal of the suspect's appeal.
The Minister is of the view that their withdrawal brings the process of extraditing them to South Africa closer to being finalised,"said Terrence Manase,Spokesperson to the Minister of Justice and Constitutional Development.
Manase has clarified that South Africa will leave everything to Eswatini authorities pertaining the finalisation of the extradition process and both countries will be updating each other,and also mentioned that the Minister is excited about the progress in that case.
"At this stage,the Kingdom of Eswatini authorities will handle the remaining procedural matters and will communicate further developments to the South African authorities in due course.
"Minister Kubayi expresses her appreciation to the South African law enforcement and justice officials who have been working closely with their counterparts in the Kingdom of Eswatini to advance this case to its current stage.
The Minister looks forward to the successful extradition of the two suspects to South Africa so that they can face justice and the families of the victims can find closure,"Manase concluded.
AKA(Kiernan Forbes) and TIBZ(Tebello Motsoane) were shot and murdered outside a restaurant on Florida Road,outside the Durban CBD,in February 2023.
