The assassin in the shadows: Former elite cop charged with "Witness D" execution

The veil of anonymity that failed to protect a whistleblower has finally been lifted from his alleged killer. In a courtroom charged with tension and heavy security, 41-year-old Matipandile Sotheni, a former member of the SAPS elite Special Task Force, appeared in the Brakpan Magistrate's Court on Monday, 16 March 2026.

Sotheni stands accused of the clinical assassination of Marius “Vlam” van der Merwe, the man known to the nation as “Witness D” during his explosive testimony at the Madlanga Commission of Inquiry.

A precision hit: From protector to predator

The state's case paints a chilling picture of a state-trained “specialist” turning his skills against a witness for the crown. Van der Merwe, a former police officer and security director, was gunned down in his driveway on 05 December 2025, in an attack involving an AK-47.

Brigadier Athlenda Mathe, SAPS national spokesperson, highlighted the technical nature of the crime:

“To execute a hit from a moving vehicle with that level of accuracy requires specialised training. In Sotheni, we have a man who cost the state R1 million to train in elite tactics, only for him to allegedly use those skills as a mercenary.”

Sotheni, who resigned from the police in 2019, had been working as a high-level private bodyguard in Houghton. Investigators believe the assassination was a contracted “side hustle” intended to silence the Madlanga Commission's most damaging witness.

The Commission's most dangerous secret

Marius van der Merwe earned the pseudonym “Witness D” after providing testimony that sent shockwaves through the Ekurhuleni Metropolitan Police Department (EMPD). He alleged that high-ranking officials were involved in:

  • The 2022 Torture-Slaying: Disposing of a victim's body at a local dam.
  • Systemic Corruption: Protection rackets involving municipal leaders.
  • Abuse of Power: The weaponisation of law enforcement for political ends.

Despite testifying behind a screen, van der Merwe's identity was leaked, leading to his execution in front of his wife and children — a move many see as a direct assault on the Commission itself.

The legal battleground

The proceedings on Monday were brief but impactful. The state has categorised this as a Schedule 6 offence, meaning the burden is on Sotheni to prove exceptional circumstances exist for his realese.

He was charged with premeditated murder, conspiracy to commit murder, possession of prohibited ammunition, and his next hearing is scheduled for 25 March 2026 for a formal bail application. 

The “Mastermind” remains at large

While the arrest of the alleged triggerman is a victory for the SAPS, the shadow of the “Paymaster” looms large. The police task team confirmed that while the driver of the getaway vehicle, Wiandre Pretorius, took his own life last month, the investigation is now pivoting toward the individual who financed the hit.

The Madlanga Commission continues its work under increased security, but the empty chair of Witness D serves as a haunting reminder of the price of truth in South Africa.
